Plácido de Abreu & Associados, registered at the Portuguese Bar Association with the number 39/11, with offices on Rua Alexandre Herculano, 23, 2nd floor in Lisbon, owner of the registered trademark PARES, ensures the privacy and protection of its Clients’ personal data, holding it as a cornerstone of its activity as a legal counsel service provider to its Clients.

Aware of the growing importance of privacy and confidentiality, PARES has been adopting the appropriate technical and organisational measures to ensure the safeguard and protection of its Clients’ personal data against its loss, destruction or accidental damage, as well as its illicit or non-authorised processing.

PARES processes its Clients’ personal data in compliance with the legislation regarding personal data protection, specifically the April 27th 2016 Regulation (EU) 2016/679 of the European Parliament and European Council (General Data Protection Regulation). Moreover, PARES also follows its own code of conduct, pursuant to personal data applicable legislation, as well as the Portuguese Bar Association’s Statutes.

The use and browsing of PARES’s website does not require the registration of any personal data that may identify the user.

Purposes, Bases and Maintenance

PARES processes its Clients’ personal data for the sole and exclusive purpose of providing legal services (“purpose of processing”).

The personal data is kept for the time strictly necessary and appropriate for the purposes of the processing, or complying with legal deadlines, specifically those established by legislation concerning money laundering and fighting the financing of terrorism.

Third Party access to Personal Data

It is PARES’s policy to reveal information to third-parties in the following cases only: (i) due to a demand or a legal notification, provided that it is duly and legally justified; (ii) if the request comes from an Authority of Control, provided that it is duly and legally justified; (iii) if based on an express request made by Clients in respect of their data.

PARES may use the services of third parties to process its Clients’ personal data in the law firm’s name and under specific instructions. Whenever it occurs, PARES ensures that the subcontracted third parties are bound by a subcontracting agreement that binds them to treat the personal data in compliance with the legislation regarding personal data protection, specifically the April 27th 2016 Regulation (EU) 2016/679 of the European Parliament and European Council (General Data Protection Regulation) and in compliance with PARES’s code of conduct.

Rights of Clients

To express its commitment to ensuring its Clients’ privacy, PARES grants effective rights under the applicable Portuguese and EU legislation that can be used as follows:

  • Right of Access: At any time, Clients may contact PARES and request confirmation that their personal data is being processed and, if so, may subsequently obtain information on: (i) the type of personal data; (ii) the purpose of its processing; (iii) the corresponding timeframe of personal data maintenance or the criteria used to set it; (iv) the rights Clients have over their data and how to use them; (v) the source of the personal data concerning the Clients; (vi) the existence of automated decisions, including profiling.
  • Right of Rectification: Whenever it is confirmed that the personal data being processed is out of date, incomplete or incorrect, Clients may request its rectification to PARES in the shortest possible period of time.
  • Right to Data Portability: Clients also have the right to: (i) have their personal data sent by PARES in a current-use format that can be read automatically; (ii) at their own responsibility, to transmit this data to third parties not associated with PARES; and/or (iii) to request PARES the transmission of said personal data to third parties.
  • Right of Complaint: Despite the fact that PARES adopts the best practices concerning personal data protection, data subjects have the right to file a complaint with the Portuguese Data Protection Authority (https://www.cnpd.pt) concerning data processing carried out by PARES, using any ways provided by the above-mentioned Authority of Control. 

Notwithstanding the rights described above and granted to Clients, PARES can only disregard the use of said rights, totally or partially, only in cases explicitly defined by law, such as:

(i) If the personal data is necessary to fulfil a contract, to which the Client is a part of, and said contract is an existing contract;
(ii) In cases where processing the data is necessary to comply with legal obligations, or for the purposes of statement or defense under legal proceedings;
(iii) Further to a request of data portability directly from PARES to a third party, if said portability is technically impossible to fulfil.
